Manufacturer's obligations

What are the manufacturer’s obligations under Regulation (EU) 2023/988 (GPSR)?

The manufacturer is required, as per Regulation (EU) 2023/988 of the European Parliament and of the Council of 10 May 2023 on general product safety (GPSR), to include the following information on the product. If this is not possible, the information must be placed on the packaging or in an accompanying document:

 

Identification and contact details:

  • Full name or registered trade name, or registered trademark.
  • Postal address and email address.
  • If applicable, the postal or email address of a single contact point, different from the manufacturer’s address, where the manufacturer can be reached.

 

Product identification:

  • Type, batch, or serial number, or other visible and consumer-readable elements that enable identification.
  • Safety instructions and information:
  • Clear safety instructions and information in a language easily understood by consumers, as specified by the Member State where the product is made available.

Important:
All information must be presented in a language that consumers can easily understand. For verbal communication, the information must be in the language of each country where the product will be sold. Pictograms may also be used.

 

What product information must be displayed on an online store?

Product descriptions visible to buyers in an online store must include the following details:

  • The full name, registered trade name, or registered trademark of the manufacturer.
  • The postal and email address where the manufacturer can be contacted.
  • Information identifying the product, including its image, type, and other identifiers.
  • Any warnings or safety information required to be displayed on the product, packaging, or accompanying documents in compliance with this Regulation or other applicable EU harmonized legislation, provided in a language easily understood by consumers in the Member State where the product is marketed.

 

What information must be provided on the manufacturer's website?

Even if the manufacturer does not sell products directly to consumers, the website must provide contact information for consumers, including:

  • A phone number.
  • An email address.
  • A dedicated section of the website, designed to accommodate the accessibility needs of persons with disabilities, allowing consumers to:
    • Submit complaints.
    • Report accidents or safety issues related to the product.

The website (at least the consumer contact section) must be available in the languages of the countries where the products are sold. This could, for example, take the form of a separate webpage for consumers.
